The network was originally uncovered during a search operation conducted on a group of fictitious charitable trusts, which were found to be facilitating accommodation entries in exchange for bogus donations and contributions.

2. Modus Operandi and Structural Anomalies

The preliminary ground verifications conducted by the tax department revealed severe irregularities in the operations and tax filings of the remitting entities:

  • Filing Discrepancies: Many of the entities making large foreign exchange remittances were either non-filers of income-tax returns or were filing returns declaring disproportionately small turnovers.
  • Mismatched Turnovers & Purposes: There was no logical or apparent correlation between the small turnovers reported by these entities and the massive volumes of capital being sent abroad. Analysis showed that a large volume of Form 15CB certificates had been issued by a highly clustered, small group of professionals, with the corresponding funds being received by a similarly concentrated cluster of foreign entities.

  • Statutory Compliance Reference: Under Form 15CB, read with Rule 37BB of the Income-tax Rules, 1962 (which corresponds to Form 146, read with Rule 220 of the Income-tax Rules, 2026), an accountant certifying a foreign remittance is statutorily required to verify its taxability. This verification must be done with direct reference to the remitting entity’s books of account and other relevant supporting documents.

  • 394 Total Entities Under Investigation: The exercise covers approximately 394 suspicious entities nationwide.
  • 117 Land-Border State Entities: Reflecting high-risk geographical scrutiny, the action covers 117 entities situated in districts along India’s land borders that have remitted significant foreign funds.
  • 36 Professionals Targeted: The verification exercise is actively scrutinizing the certification practices of 36 professionals who issued the relevant Form 15CB certificates.

The Central Board of Direct Taxes (CBDT) has issued a stern advisory to the accounting community.
